Please read our terms and conditions carefully. By purchasing products from this website we will assume that you have understood and accepted them.

These terms and conditions ("Terms of Use") are in addition to our privacy policy and our returns policy. These Terms of Use apply to the purchasing of goods from Nite International Limited available through nitewatches.co.uk (the "Services").

These "Terms of Use" govern the relationship between you (the consumer) and us when you access and use the Services (the "Agreement"). By accessing and continuing to use the Services, You agree to be legally bound by these Terms of Use.

Nite International reserve the right to update and amend these Terms of Use and any changes will be posted on the Services. It remains your responsibility to ensure you have reviewed the Terms of Use regularly and familiarise yourself with any changes. If you do not agree with any of our Terms of Use then you should not use our Services.

About You

You confirm that You are over 18 and the valid holder and owner of any credit or debit card used during Services. We reserve the right to refuse your order at our discretion.

Order Process

After viewing a product you would like to purchase, click the button 'Add to basket'. You will be taken to your order summary ( the "Order" ) where you can update your required quantity and choose to confirm the purchase of the listed item(s) by clicking the button 'Checkout'.

You will be prompted to enter your billing/delivery details before entering your payment information on a secure checkout page.

If we cannot supply You with the products or services You have ordered, we will cancel Your order and inform You of this as soon as reasonably possible. We will give You a full refund where You have already paid for the products or services.

Your Order constitutes an offer to us to buy a product or service. All orders are subject to availability and to acceptance by us. Please note the contract for purchase of the product or service is formed and only becomes binding when we successfully receive payment from You.

While we will do our best to fulfil Your order (once it is accepted), we cannot guarantee to do so (for example where Your card issuer refuses to authorise payment or if products or services have be incorrectly priced).

Prices

We accept international MasterCard, Visa, Maestro and Solo. Our invoices will appear as Nite International.

Order totals at the checkout page on this website are shown in Pounds Sterling (£). VAT is included in the price (unless otherwise stated) and will be charged at the rate applicable to standard UK legislation at the time of purchase and is subject to change without notice. Nite International Limited is VAT registered and our VAT number is 928 8201 10.

The price of a product or service shall be as stated on this website at the time you place your order. All product or service descriptions and illustrations shown on the website are provided in good faith but are intended as guidance only and actual products or services may vary accordingly.

We try and ensure that all prices on our website are accurate but errors may occur. If we discover an error in the price of a product and/or service you have ordered before you confirm your order, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or canceling it. If you cancel your order payment will be refunded to you card.

Payment

Payment will be taken at the time of or shortly after you confirm your order. Payment will be taken from your credit or debit card and will show as 'Nite International Limited' on your bank statements.

You confirm that the credit/debit card or other payment method that is being used is yours. All credit/debit card holders and payment accounts are subject to validation checks and authorisation by the card issuer and/or payment processor. If the issuer of your card and/or payment processor refuses to authorise payment we will not accept your order and we will not be responsible for any delay or non-delivery. We are not obliged to inform you of the reason for the refusal of an order.

We are not responsible for your card issuer, bank or payment account charging you for processing your payment in accordance with your order.

Delivery

Delivery for orders totalling over £98 is free within the UK, under that threshold UK delivery will be charged at £2.95. Delivery for addresses in Europe will cost £14.99 and deliveries for the rest of the world will cost £19.99.

You will normally receive two emails from us in the form of a confirmation of receipt of order and payment followed by notification of dispatch of goods. Once an order and payment has been processed, goods will be shipped by our nominated Courier within 48 hours.

The estimated delivery period is as follows:
UK: 12 to 48 hours
EU countries: 2 to 7 days
Rest of World: 7 to 14 days

We will make every effort to deliver your order within the above timescales. However, this is a guideline and delivery cannot be guaranteed. We will not accept responsibility for delays caused by any national postal service. If the goods are not delivered within the time we have estimated, please feel free to contact us by telephone +44 1201 487757 or email and we will do everything possible to resolve the issue promptly. We will not be liable for any loss caused to you by late delivery.

Please also note that we do not dispatch goods to PO Boxes and reserve the right to cancel any order where the address is later found to be a PO Box.

It is the Customers responsibility to notify us if the goods have not been received within 21 days of the estimated delivery date or receipt of our invoice. If no notification is made within this time period the buyer shall be deemed to have received the goods.

You will not do anything that may cause damage to the Services or our servers, systems or equipment or those of third parties, nor access or attempt to access any users' data or to penetrate or attempt to penetrate the Services' security measures. You agree to compensate us in respect of any damages suffered by us or any of our losses resulting from any claim made by a third party in each case in respect of any matter arising from Your use of the Services in breach of these Terms of Use or from Your violation of any applicable law or regulation.

You agree not to give any indication that You have any commercial relationship with us, or that You are our agent. We reserve the right to suspend, restrict or terminate Your access to any, or all, our Services at any time at our sole discretion if we consider You are or may be in breach of these Terms of Use.

We may terminate this Agreement with You by giving You reasonable notice via E-Mail or in writing.

Intellectual Property

All intellectual property rights on the Services and all material or content made available by Nite International Limited via the Services shall remain at all times the property of Nite International Limited . The names, images and logos identifying us, Nite International Limited, our partners or third parties and our/their products and services contained in the Services are proprietary marks and may not be reproduced or otherwise used without express permission. Nothing contained in these Terms of Use shall be construed as conferring by implication any licence or right to use any trade mark, patent, design right or copyright of Nite International Limited or of any third party.

Links to Other Sites and Services

The Services may contain links to other third party sites and services through advertising or otherwise. These links are provided for Your ease of reference and convenience only. We have no control over those third party sites or services and are not responsible for their contents. We do not endorse the material contained in their sites or services, and have no association with their operators.

You agree that we won't be party to any transaction or contract with a third party that You may enter into and we won't be liable to You for any loss or damage which You may suffer by using those third party sites and services. You agree that You will not involve Nite International Limited in any dispute You may have with such third party sites and services.

Our Legal Obligations and Limits On Liability

Nothing in these Terms of Use will restrict Your statutory rights (including Your rights to receive a reasonable standard of service, more details about which can be obtained from Your local Trading Standards Office or Citizen's Advice Bureau); or limit our liability for death or personal injury resulting from our negligence or for fraud.

These Terms of Use shall not make us responsible for any damage or loss caused to You where such damage or loss is not reasonably foreseeable to You and us when You agree to these Terms of Use (which occurs automatically when You access and continue to use the Services), including where the damage or loss results from our breach of these Terms of Use. We do not accept liability for any damage or loss caused to You where You are not entering into these Terms of Use as a consumer.

The Waste Electrical and Electronic Equipment Regulations (WEEE Regulations)

The Waste Electrical and Electronic Equipment Regulations are now part of UK law. The UK has agreed to reduce the amount of WEEE that is being disposed of in landfill sites.

It is important that the amount of WEEE sent to landfill sites is reduced because:

Some WEEE can be re-used or recycled. The amount of landfill space available in the UK is decreasing. If we can keep WEEE out of landfill sites it means there is more landfill space available for non-recyclable waste.

WEEE can contain hazardous substances. When left in landfill sites the hazardous substances in WEEE can pollute soil and contaminate water supplies. This contamination can damage human health and the environment.

Distributors of new Electric and Electronic Equipment (or EEE) have a part to play in reducing the amount of WEEE going into landfill sites.

Nite International Limited is observing these regulations by offering our customers free take-back of their WEEE on a like-for-like basis when they purchase a battery operated or electronic product.

For example, if a customer buys a new battery operated watch from us we will take back their old watch (provided it is of equivalent type and function) and prevent it going into a landfill site by disposing of it safely. Customers must return their old WEEE within 28 days of purchasing their new item. Customers do not have to pay to return their old item to us.

The Waste Electrical and Electronic Equipment Regulations

Goods are marked with this symbol to show that they were produced after 13th August 2005, and should be disposed of separately from normal household waste.

Important Terms

The Terms of Use supersede any other terms and conditions for use of this website previously published by us.

These Terms of Use are available in English only and shall be governed by and construed in accordance with the laws of England (or the laws of Scotland if You are domiciled there). Disputes arising in connection with these Terms of Use shall be subject to the exclusive jurisdiction of the courts of England and Wales unless You choose the jurisdiction of Your domicile in Scotland or Northern Ireland.

Nite International Limited will undertake to handle complaints fairly and competently. We will keep you informed either by telephone or email at each stage and will endeavour to fully resolve your complaint within 72 hours.
